Washington Physicians Fight To Improve Patient Access To Care, Protect Patient Safety, And Improve Quality

Washington State Medical Association (WSMA) Weighs in on Legislation in Olympia

OLYMPIA, Wash., Jan. 31, 2013 /PRNewswire-USNewswire/ -- As expected, there are many issues being discussed in the 2013 state legislative session that affect physicians and patients in our state. The Washington State Medical Association (WSMA) is working to make sure the voices of physicians are heard to improve patient access to care, protect patient safety, and improve quality, without putting added burdens on physicians.

"With all of the recent change in the health care system, there has never been a more challenging time to practice medicine," said Nick Rajacich , MD, president of the WSMA. "Physicians must be at the table as these big decisions are being made and implemented because they will have a lasting impact not only on physicians practicing medicine, but on patient access to quality, safe health care. Washington's physicians will continue to fight for our patients."

Here are some issues on which the WSMA is advocating:

Health Benefit Exchange – Our state is currently developing a health benefit exchange—Washington Healthplanfinder—allowing all Washington residents to choose the health plan that is right for them and their families. Individuals whose incomes fall between 133 percent and 400 percent of the federal poverty level will qualify for a federal subsidy to help purchase products on the Exchange. It's estimated that 532,000 Washingtonians would be eligible for federal subsidies to purchase plans through our state's Exchange and that 280,000 people in our state are likely to take advantage of the program by the end of 2014. By 2017, that number could grow to over 470,000. All of these newly-insured patients will need physicians to care for them. WSMA is working to ensure there is access to care through adequate provider networks before these insurance products are offered to the public.

Medicaid Expansion – It is expected that there will be 260,000 new Medicaid enrollees by 2019, an increase of more than 25 percent. The WSMA is working closely with the state legislature and the Health Care Authority to ensure there are adequate provider networks in place as these new patients will need physicians to care for them, and that physicians' reimbursement is not further reduced.

Emergency Room Visits and PMP Funding – Last year the WSMA, the state hospital association and emergency physicians worked together to successfully implement the "Seven Best Practices" to reduce unnecessary emergency room use by Medicaid patients, saving the state $31 million. Part of that success is attributed to widespread participation in the Prescription Drug Monitoring Program (PMP) which will run out of funds in July. In the past there have been efforts to fund the program via physician licensure fees. The WSMA will oppose those efforts and instead will propose the Medicaid Fraud Account as a dedicated funding source. We will continue to work with our coalition and the state to broaden our success and make sure physicians are involved in any new policy developments.

Contracting Fairness – WSMA will introduce legislation to require an affirmative response from the physician to any material changes in provider contracts. In addition, the WSMA supports legislation that prohibits tying physician licensure with participation in any third-party insurance programs, including state health care programs.

Degree and Training Transparency –The WSMA believes that all healthcare professionals should clearly and accurately identify themselves to patients. Many healthcare professionals can earn advanced degrees that carry the title "doctor," including doctor of physical therapy, doctor of nursing, doctor of psychology, doctor of audiology, doctor of naturopathy, doctor of chiropractic, doctor of optometry and more. The WSMA will support legislation for full disclosure to patients of a doctor's professional degree and training.

Budget and Delivery System Reform – The WSMA is a proactive participant in advocating for other changes, including:

  • Further adoption of the advanced medical home concept
  • Defending against cuts to physician payment by state health care programs
  • Ensuring expiration of the physician B&O tax.

Long Waits For Consumers When Medicare Is 'Secondary Payer'

Anyone who sues for personal injury probably knows that the process may take time. But for Medicare beneficiaries, too often it's not only the legal system that grinds slowly. Lawyers and policy experts say bureaucratic inefficiency at the federal Centers for Medicare & Medicaid Services (CMS) can add months or even years to the process. During that period, a beneficiary often must wait until Medicare is reimbursed for its costs before he or she can receive any payment.

A new law that, among other things, spells out clear schedules for providing details about medical claims is expected to reduce those delays.

The problem generally arises when a Medicare beneficiary believes he or she was harmed because of another party's negligence: getting hit by a car while crossing the street, for example, or suffering lasting injury because of a careless surgical error.

The Medicare beneficiary typically hires a lawyer, who contacts the legal representative for the other side. Often the parties try to reach a financial settlement rather than go to court.

In such cases, Medicare has generally paid the injured person's medical bills. But if there's a settlement or a judgment in the victim's favor, the other party's liability insurer typically becomes what's known as the "primary payer" - i.e., the party responsible for the medical bills. Medicare becomes the "secondary payer" and is then entitled to reimbursement for the money it has already spent on the victim's medical care.

That's where it gets sticky. To settle a case, lawyers generally want to know the amount of the medical bills that have been incurred. An $80,000 settlement doesn't make sense if Medicare is owed $60,000 for bills it has already paid. After the plaintiff's attorney takes his fee, usually one-third of the settlement amount, there would be nothing left to compensate the victim for pain and suffering, inability to work, etc.

"At a mediation, if you don't have solid numbers it's impossible to settle a case," says Mary Alice McLarty, a plaintiff's lawyer who is president of the American Association for Justice, a trial lawyers' group.

CMS frequently doesn't make details available about the expenses it has incurred for several months after litigants inform the agency that a case is pending, defense and plaintiff's attorneys say. Without that information, the case stalls and Medicare beneficiaries are left in limbo.

In one case involving an 80-year-old man who was injured in a car accident in Kentucky in November 2011, it took more than a year to get a final figure from CMS detailing how much the agency was owed, says Linda Magruder, an attorney in Louisville who was the victim's co-counsel in the case. That amount, for treatment for soft-tissue injuries to the man's right hip, left foot, back and neck, was $2,640. But the agency first claimed it was owed more than $26,000, she says, because it included bills for care not related to the accident.

Until the discrepancies were addressed, the man was unable to receive his share - roughly $30,000 - of the $50,000 insurance settlement.

"All this stuff is computerized," she says. "Why should it take so long to put it together?"

The slow reporting process isn't only a problem for individual beneficiaries, experts say. These inefficiencies mean that the Medicare Trust Fund doesn't get repaid promptly for care, either.

In 2011, more than 480,000 new cases were recorded, and CMS realized more than $860 million in payments and savings related to such cases, according to a Government Accountability Office report.

"The reforms to [the] process are improvements that shore up Medicare's long-term finances and save the taxpayers money," said Rep. Tim Murphy (R-Pa.), one of the new law's co-sponsors, in a statement.

CMS officials offer a different perspective on how the process works. Deborah Taylor, director of the agency's Office of Financial Management, said in a statement that once a case is established under the current system, it generally takes 45 days to make Medicare's reimbursement amount available to beneficiaries and their representatives. Updates for newly processed claims are available within 48 hours, she said.

"CMS's goal is a Medicare secondary payer program that operates at the highest level of customer service," she said. "We have made numerous improvements that not only improve efficiency in the program but also protect the interests of beneficiaries and the Medicare Trust Fund."

The new law, the Strengthening Medicare and Repaying Taxpayers (SMART) Act, signed by President Obama this month, sets time frames for CMS and Medicare beneficiaries to provide information in cases where a settlement is expected.

Under the law, a beneficiary must notify CMS if he is expecting a settlement within 120 days. CMS then has 65 days to tell the parties how much it believes it is owed. The agency can request an additional 30 days if necessary.

If beneficiaries believe the amount posted is wrong, they can provide documentation to CMS, and the agency has 11 days to respond. The law also limits to three years the time CMS has to pursue reimbursement.

The law doesn't address all the problems with the current process, says Bill Kennedy, a lawyer in Philadelphia who defends health-care providers and insurers in liability matters.

Still, he says, "by creating some certainty and a means by which people can find out the number [that CMS is owed], Medicare is stronger and the consumer is stronger."

A paraffin manicure is a treatment that involves plunging your  hands (or feet) into hot, molten wax. The wax is then covered with plastic and allowed to “soak into” your skin. When the hardened wax shell is removed, you skin is left feeling smooth and moisturized. The process supposedly improves the quality of your manicure and some people even allege that it opens pores to release toxins and even soothes arthritis.

Waxing eloquent

Believe it or not, the magic ingredient in a paraffin manicure is not really paraffin at all, it’s actually….mineral oil!  Yep, that’s right the same petroleum byproduct that’s vilified by so many people because they believe it is unsafe. You see paraffin wax and mineral oil are both extracted from crude oil and then purified to remove any impurities, particularly cyclic compounds, that can be hazardous. So, both mineral oil and paraffin wax consist of almost pure alkanes which are straight chain hydrocarbons that are nearly inert and about as safe as they can be. The name paraffin comes from the Latin “parum (barely) and affinis (affinity) meaning it lacks affinity or lacks reactivity.

Many commercial paraffin manicure products are are actually mixed with mineral oil. For example, here’s the ingredient list for a Thermal Spa product:  paraffin, mineral oil, Aloe barbadensis leaf extract, lanolin, soybean oil, fragrance, citronellol, coumarin, eugenol, limonene and linalool. Even “pure” paraffin wax contains about 0.5% oil.

Mineral oil (a.k.a. baby oil) is an extremely effective moisturizer. The wax shell helps hold the oil place to make sure that it is absorbed into your skin. When I say “absorbed” I’m talking about only into the stratum corneum which is the upper layer of skin which is dead. Mineral oil does not penetrate into the deeper layers or into the bloodstream. The mineral oil is very hydrophobic (repels water) so it helps keep moisture locked deep in your skin. While the wax-oil mixture does soften skin it won’t really provide any benefit for your nail polish. That’s because paraffin is much softer than the resins used to polish your nails.

A paraffin manicure is certainly a pampering indulgence but don’t expect to do much for your nails or cure your arthritis. And if you’re in a hurry and don’t have time to melt a pot of wax, try rubbing a little baby oil on your hands and feet to get a similar softening effect.

Self-Help Treatment for Panic Attack

Although it is not advisable to diagnose yourself with panic attack, it is really not sensible to wait until your supposed “attack” is over before you do something about it. Here are the things you must know so that when you feel that you are having an attack, you know what to do:

Understand what panic attack is all about. Awareness is the most important weapon to combat panic attacks because when you feel or know that you are under an attack, it is much easier for you to counter the effects of the symptoms that go along with it.

Remember this: panic attacks can happen to anyone. It can happen to stressed and depressed person as well as happy and healthy ones. It can happen without warning, without any apparent reason.

Triggers can also cause irrational and exaggerated fear and anxiety. Chemical imbalance in the body (low serotonin and low progesterone levels) can trigger an attack. And while there are so many studies that suggest some causes of panic attacks, the condition is still not fully understood.

Know its symptoms. For most many people, there is no easy telling whether or not they are experiencing a panic attack during the moment of attack since it is difficult for them to rationalize things and to differentiate what is real from the unreal. While this is the case, it is not really an excuse.

Here are the symptoms of panic attacks: heartbeat or palpitation, chest pain, hyperventilation or shortness of breath, stomach churning, upset stomach, trembling and shaking, muscle tension, sweating, dizziness and light-headedness, hot or cold flashes, tingling sensation or numbness, fear of dying, going crazy or losing control and feeling detached from the surroundings. Take note that people react to triggers differently, thus symptoms may vary from person to person.

Practice deep breathing. Deep breathing during an attack is the most effective way to reduce the symptoms you are experiencing as well as divert your attention from the fearful thought. Breathe in deeply for 3 slow counts, hold your breath for 3 slow counts, and breathe out for another 3 slow counts. Repeat this process until you feel you are calm. You can also breathe into a paper bag. This reason for this is that re-breathing your carbon dioxide helps correct the blood acid level that had been disturbed by excessive breathing.

Stay positive. While it is easier said than done, staying positive during an attack will speed up your recovery. Let the situation flow while keeping in mind that it will going to pass. An attack peaks for 5 to 10 minutes and rarely extends for more than half an hour so do not think that you are going crazy (or going to die) even if it feels that you are going crazy (or going to die).

Avoid unnecessary stress. While you cannot avoid every stressful situation and it is also unhealthy to turn your back on situations that need to be addressed, avoiding unnecessary stress help reduce the chances of you experiencing an attack. Stay away from people who stress you out, from relationship that causes stress, and situations that get you tensed.

Learn to say “no” if you have other much important things to do; do not work for extended hours; do not accept additional work if you know you cannot do it properly, etc.

Canine cosmetics

Dogs have a pretty good life except when it comes to skin care. Their skin doesn’t produce sebum the way ours does and certain breeds are prone to dry skin conditions. Regular skin lotions don’t work so well through all that hair but there is a special “lotion” for dogs that’s supposed to fight dermal inflammation, itching, bacterial and even fungal infections. The product is called DogsBestFriend and it’s made by Brookton Labs, the pet division of BioNexus, LTD.

The product consists of an aloe vera base containing an extract of Nigella sativa which is rich in thymoquinone along with omega-3 and -6 fatty acids. The fatty acids  form a moisturizing barrier while the thymoquinone and vitamins E and D3 help soothe skin.

Does this stuff really work?

I couldn’t find any definitive studies in the literature but the manufacturer does site a number of references to support that this extract is an effective anti-inflammatory as well as to show it is safe. If your dog has an occasional problem with itchiness this product might be worth a try but if the problem is chronic and more severe, you should consult with your vet.

TOKYO, Jan. 25, 2013 /PRNewswire/ -- The Nippon Foundation held a launch ceremony in London on January 24 for the "Global Appeal 2013" designed end stigma and discrimination against people affected by leprosy, calling for the immediate abolition of laws and systems still discriminating against patients and recovered patients despite the fact that Hansen's disease has became curable.

The Nippon Foundation Chairman Yohei Sasakawa , acting as WHO Goodwill Ambassador for Leprosy Elimination, has been making the appeal annually since 2006 with the endorsement of religious, educational and human rights organizations around the world, with the eighth appeal in 2013 supported by the International Bar Association (IBA) and 46 affiliated bar associations in 40 countries and one region.

Nearly 200 people, including members of the bar and a representative of an Indian organization of recovered patients, were present at the ceremony held on the afternoon of January 24 in London. Lucy Scott-Moncrieff , president of the Law Society, told the audience: "It is truly significant that lawyers are taking a major role in the fight against the discrimination and injustice in this area." Former IBA President Akira Kawamura added, "The outdated attitudes and laws surrounding leprosy cause great suffering to many people. Today the members of legal professions across the world have an opportunity to work together to correct the situation." The Nippon Foundation's Sasakawa said, "Wrong laws and rules have helped encourage discrimination and stigma deeply planted in the minds of people," calling for their immediate repeal.

Over 16 million people affected by Hansen's disease have been cured over the world after the development of treatment drugs in the 1980s. But they are still faced today with misunderstanding and prejudice formed in the long history of the disease and are seriously discriminated against in marriage, employment and education. In India and some other countries, laws and institutions, which discriminate against patients and recovered patients, still remain unchanged.

While even my beauty-ignorant self knew back then that he had special hair powers, I’m now even MORE convinced of his supreme talents. Think about that. I’ve been a total haircut guinea pig, experiencing the so-called best of the best as a beauty editor…  and yet I’ve decided that nobody gets it like Bill gets it.

A High Raw Food Diet...Your Ticket to Better Health

The raw food diet is as much a life-style as an eating plan; a naturalistic approach which excludes, in addition to cooked and animal foods, processed and refined ingredients.

In the ever-hungry quest for new fads and health panaceas, the raw food diet, with adherents such as Woody Harrelson and Donna Karan, is growing in mainstream popularity. Unlike many other bandwagons however, raw foods (also referred to as ‘living foods'), offer unarguable health benefits and one can reap rewards even as a 50% dabbler. To be a 100% extremist takes commitment, discipline and education and is best introduced gradually to avoid the overwhelm of inevitable detoxification.

A food is essentially ‘raw' if it is kept below 115 degrees Fahrenheit, the temperature above which enzymes are destroyed. Eating raw food ensures an opulent intake of nutrients, fibre, healthy oils and life-giving enzymes. Raw food is much more easily digested, taking half to a third of the time of cooked food, around 24-36 hours compared to 40-100 hours. Raw vegetables and fruits, are also predominantly alkaline so help to optmize the pH balance of the body (around 60-80% alkaline foods being recommended for a healthy internal environment resistant to disease).

Sprouts, raw juices and superfoods are favoured in a raw food diet, and dehydrating ‘ovens' effectively concentrate the flavour of certain raw foods to assist in the creation of a mind-boggling array of as-cooked dishes. I've eaten a raw food pizza that unbelievably contained no wheat, no cheese and no cooked ingredients! It tasted delicious and I was stumped to figure out what it was actually made of!

Raw plant foods are healthy, regenerative, cleansing, energising, predominantly alkaline, and packed with vitamins, minerals, healthy oils, enzymes and antioxidants that promote health, beauty and longevity. As well as enhancing digestion and protecting against aging and disease, a raw food diet has noted weight loss benefits and promotes clear, beautiful skin.

The benefit of raw food becomes even more apparent in view of the effects cooking can have on constituents in food.

The Effects of Cooking

Arthur Baker writes in Awakening Our Self-Healing Body, ‘Overly cooked foods literally wreck our body. They deny needed nutrients to the system since heat alters foodstuffs such that they are partially, mostly, or wholly destroyed. Nutrients are coagulated, deaminized, caramelized and rendered inorganic and become toxic and pathogenic in the body.'

The indigestible end products of cooked foods can linger in the gut, clogging the intestines and interfering with healthy elimination. They can cause a build-up of toxins, mutagens and carcinogens. Carbohydrates ferment, proteins putrefy and fats become rancid, creating free radicals that enter the blood stream.

Lipufuscin, the ‘aging pigment', is an example of a waste product created from damaged proteins and fats. It accumulates in the skin and nervous system and is visible as brown ‘liver spots' on the skin and eyes.

Toxic by-products and excess free radicals from cooked foods can weaken the immune system and accelerate the aging process.

Enzymes

Cooking destroys enzymes in our food. These delicate, heat sensitive proteins can destabilise at temperatures as low as 115 degrees Fahrenheit, hence even light steaming can render them inactive.

All living cells contain enzymes which function in cooperation with other minerals. As there is not an unlimited supply of enzymes, eating them in our food lifts the burden off organs to produce digestive enzymes which allows a greater use of enzymes for other metabolic purposes, freeing up more energy for the performance of other tasks.

Nutrients

In cooking food we can loose up to 97% of water-soluble vitamins (B and C) and 40% of fat-soluble vitamins (namely A, D, E and K).

Proteins

Heat denatures proteins, modifying their molecular structure and rendering them unusable. The bacteria in the gut feeds upon undigested proteins that tend to putrefy, giving rise to toxins. Raw foods provide healthy, readily available protein in greater supply without unwanted residue.

Fats

As oils are heat, light and air sensitive, heating can destroy the goodness of the and can alter molecules generating toxins and free radicals. Unrefined oils that are cold-pressed contain all their natural healthful substances (olive oil for example is rich in phytonutrients, flaxseed oil a great source of omega-3 fatty acids and so on). They should be kept refrigerated in dark sealed containers.

Fibre

Fibre is essential for health and helps to flush out the intestines, scrubbing them clean and aiding elimination. With cooked food fibre becomes a soft substance, loosing its brush-like quality. It can partially rot, ferment and putrefy in the gut, causing toxins, gas and heartburn.

Egg allergic children did not have adverse reactions to single dose of influenza vaccine in multi-center study

ANN ARBOR, Mich., Jan. 22, 2013 /PRNewswire-USNewswire/ -- Egg allergic children, including those with a history of anaphylaxis to egg, can safely receive a single dose of the seasonal influenza vaccine, according to a new study from the University of Michigan.

Historically, the CDC recommended that the seasonal influenza vaccine not be administered to egg allergic children.  Recent research conducted at the University of Michigan, and elsewhere, helped modify this recommendation in 2011 so that caution was warranted for only those with severe egg allergy.

The new study, published in the Annals of Allergy, Asthma and Immunology, is good news for children who've had severe egg allergies, given the prevalence of the flu this season. In the study, none of the children with severe egg allergies developed an allergic reaction after receiving the vaccine, says Matthew Greenhawt , M.D., M.B.A., MSc, lead author of the study and assistant professor of allergy and immunology at the University of Michigan's C.S. Mott Children's Hospital.

"The flu vaccine is grown in embryonated chicken eggs and contains residual amounts of ovalbumin, a major egg allergen. This has historically raised concern about the safety of the vaccine in children with egg allergies," says Greenhawt.

"But this study shows these children, all of whom either had anaphylaxis or a severe allergic reaction from egg, can tolerate the vaccine.  That's important because we know it's crucial that children get a vaccine to avoid the flu, especially this year as we've seen such an increase in cases and severity. The benefits outweigh the risks."

Influenza A is responsible for 21,156 annual hospitalizations of children younger than five years. The CDC reports that influenza activity right now is high and widespread across the nation. Thirty states and New York City were reporting high activity during the week of Jan. 6. As of Jan. 12, the total number of influenza-associated pediatric deaths was 29 for 2012-13. As many as one-third of children with a food allergy have asthma, and this group is particularly susceptible to influenza.

The American College of Allergy, Asthma and Immunology this month announced that administration of the flu vaccine is safe even in children with a history of a severe allergic reaction to eggs. In its recommendation, the College cited the U-M  study.

Egg allergy is one of the most common food allergies in children, but by age 16 about 70 percent outgrow the allergy.

The study showed that a single dose is safe, Greenhawt adds, making it unnecessary to administer the dose in two steps, one of the techniques used in the past to minimize the risk of allergic reactions. He adds that skin testing to the vaccine, another technique used in the past to minimize this risk, is also unnecessary, as was proven in a past U of M study in 2009. Such precautions may have served as barriers to vaccination in the past.

Greenhawt says the only precaution needed is that egg-allergic children should be observed for 30 minutes after vaccination in any medical setting, including primary care providers' offices, where an allergic reaction could be recognized and treated should it occur.

"Because of the prevalence of egg allergy in children is approximately 2%, we know there are a significant number of children who don't get the flu vaccine. This study can put parents' fears to rest and hopefully help more kids avoid the flu," he says.

The study was conducted from October 2010 to March 2012 at seven institutions, including the University of Michigan.

When I was leafing through our local newspaper the other day, I came upon this obituary, and it jumped off the page at me because - well, it's not often you seen an obituary for a pet in amongst the obituaries for humans

When I was leafing through our local newspaper the other day, I came upon this obituary, and it jumped off the page at me because – well, it’s not often you seen an obituary for a pet in amongst the obituaries for humans. What a wonderful way to remember a loved and missed animal companion, and what a wonderful way to get people in the mainstream thinking about the fact that animals are individuals too – ones who are missed greatly when they are gone.

It got me thinking about something else as well. In the vegan movement, we often lament the fact that while we (as a species/culture) treat some animals with the deepest respect – revere them enough, for example, to place an obituary in the newspaper when they die – we mindlessly eat and wear others. This beautiful obituary made me wonder what the impact would be if each vegan took it upon him/herself to place one obituary in their local newspaper for a non-human animal friend – especially if those friends were cows, pigs, chickens, rats, or other animals humans don’t “traditionally” consider pets.

First, let’s be clear about what “nourish” means in the context of hair care.

Is there a difference between “nourish” and “condition”?

You can nourish garden plants by adding water and fertilizer to the soil they grow from. But hair that has already grown out from your scalp can’t be nourished like that because it’s dead. All you can really do is condition it. The definition of conditioning, according to “Conditioning Agents for Hair and Skin,” is as follows:

A product can be said to have conditioning properties if it improves the quality of the surface to which it is applied particularly if this improvement involves correction or prevention of some aspects of surface damage.

This point is often lost because the cosmetic industry has uses so many synonyms for condition but when it comes to hair, condition, nourish, moisturize,  revitliaze, replenish, restore, vitalize, all basically mean the same thing.

Which ingredients provide the best conditioning?

While it’s true that some conditioning agents (like coconut oil) do have the ability to penetrate hair and help strengthen from within, the vast majority of ingredients work by coating the hair. If left on the hair, almost any kind of oil will provide some degree of conditioning but they can also leave hair feeling greasy and weighed down. Other ingredients, like cationic conditioners and silicones, are designed to remain on the hair after rinsing and they provide superior lubricity and shine.

Elasticizer versus Phytodefrisant

The Phillip Kingsley product is a relatively standard rinse out conditioning treatment which is based on silicones and cationic polymers.  The Phtyo product, on the other hand, doesn’t contain any traditional conditioning agents. It’s all plant extracts and is designed to give your hair texture during heat styling. Since it’s not rinsed out the starchy plant materials are left in the hair where they will provide texture. There’s no scientific data, however, to back up their claim that  the “Straightening effect is cumulative with continued use.”  So, if you want the most “nourishment” for your hair, Elasticizer will give you the most benefit. If you want an all “natural” styling product, then try the  Phytodefrisant Botanical Hair Relaxing Balm.

In reality, silicones are just as “nourishing” as any other ingredient that you can put on your hair.
